South Carolina Gun Industry Liability Bill
A bill currently before the South Carolina legislature would add new state-level protections for firearm manufacturers, dealers and sellers from certain lawsuits involving the criminal or unlawful misuse of firearms.
H.4723, the South Carolina Protection of Lawful Commerce in Arms Act, would generally prohibit certain civil liability claims against a firearm dealer, manufacturer, seller or trade association when a legally sold firearm is later misused by someone else.
The bill does include exceptions for certain circumstances and is currently in the South Carolina House.
That raises a pretty straightforward question:
Should a gun store or manufacturer be held financially responsible when someone criminally misuses a firearm they legally sold?
Or should liability require some wrongdoing by the business itself?
